As Affleck is still in treatment and looking out for his own best interest, it is understandable that Garner might want to take care of things between the children at the moment until it's confirmed that Affleck is sober and functional. Once he is settled down into his new lifestyle and it is evident that he is able to raise these children in a safe, productive household, they could always revisit the decision.
